Facts:
Defendant in Fairfax appealed
a judgment of the Court of Appeals of Virginia, which affirmed a guilty finding
in a circuit court bench trial, held after defendant appealed his conviction
for drunk driving (DUI) from the general district court. The Court of Appeals
held that defendant was the "operator" of his car within the
proscription of Va. Code Ann. § 18.2-266 because he was in actual physical
control of the motor vehicle.
